GetSorted™ Terms of Use

These Terms of Use ("Terms") govern your use of the GetSorted™ mobile application, related websites, and related services (collectively, the "Service").

GetSorted™ is owned and operated by BrightCasa LLC ("BrightCasa," "we," "us," or "our").

By creating an account, downloading, accessing, or using GetSorted, you agree to these Terms. If you do not agree, do not use the Service.

1. What GetSorted Is

GetSorted is a home organization and inventory tool designed to help users organize spaces, containers, belongings, notes, photos, labels, and related household information.

GetSorted may support features related to:

• Home organization
• Inventory tracking
• Moving preparation
• Smart Labels and QR codes
• Item photos and notes
• Estimated values
• Insurance documentation
• AI-assisted organization
• Future estate-planning or household-management features

GetSorted is an organizational tool only. It is not an insurance company, appraisal service, legal service, estate-planning provider, financial adviser, or professional inventory certification service.

2. Eligibility

You must be at least 13 years old to use GetSorted.

If you are using GetSorted on behalf of another person, household, organization, or business, you represent that you have authority to accept these Terms on their behalf.

3. Your Account

You may need to create an account to use certain features.

You agree to:

• Provide accurate information
• Keep your login credentials secure
• Notify us promptly if you believe your account has been accessed without permission
• Accept responsibility for activity that occurs through your account, unless caused by our failure to reasonably protect it

You may not share your account in a way that creates security, privacy, or access problems.

4. Your Content

You may add content to GetSorted, including photos, item descriptions, estimated values, notes, Smart Label information, and household organization details ("Your Content").

You retain ownership of Your Content.

You give BrightCasa a limited, non-exclusive right to store, process, display, transmit, and use Your Content only as reasonably necessary to operate, maintain, secure, support, and improve GetSorted.

For example, we may process a photo when you choose to use an AI-assisted organization feature.

You are responsible for Your Content and represent that:

• You have the right to upload or use it
• It does not violate another person's rights
• It is not illegal, harmful, abusive, fraudulent, or misleading
• It does not contain content that you are not authorized to share

Do not upload highly sensitive personal information unless you are comfortable storing and processing it through the Service.

5. AI-Assisted Features

GetSorted may offer AI-assisted features, including photo-based item suggestions, labeling suggestions, categorization, or organizational recommendations.

AI-generated results may be incomplete, inaccurate, or unsuitable for your circumstances.

You are responsible for reviewing and deciding whether to use, edit, accept, reject, or rely on AI-generated suggestions.

Do not rely on AI-assisted results as:

• Insurance valuations
• Professional appraisals
• Legal advice
• Estate-planning advice
• Safety advice
• Professional inventory certification

6. Estimated Values and Insurance Information

Any value, category, description, report, or inventory information entered into or generated by GetSorted is for personal organizational use only.

GetSorted does not guarantee:

• The value of an item
• Insurance coverage
• Claim approval
• Replacement cost
• Appraisal accuracy
• Completeness of an inventory report
• Acceptance of records by an insurer, attorney, executor, court, or other third party

You are responsible for confirming information with your insurance provider, appraiser, attorney, estate planner, or other qualified professional when needed.

7. Acceptable Use

You may use GetSorted only for lawful personal, household, or authorized business purposes.

You may not:

• Use the Service for illegal, fraudulent, abusive, or harmful activity
• Upload viruses, malicious code, or harmful files
• Attempt to access another user's account or data without permission
• Reverse engineer, copy, modify, or create competing services from GetSorted except where law specifically allows it
• Interfere with the security, operation, or availability of the Service
• Use automated systems to scrape, overload, or misuse the Service
• Misrepresent your identity or relationship to BrightCasa

8. Account Deletion

You may request deletion of your GetSorted account and associated personal information through the app, where available, or by contacting us at hello@brightcasa.co.

Deletion requests may require identity verification.

Some information may be retained for a limited period when reasonably necessary for backups, fraud prevention, security, legal obligations, dispute resolution, or enforcement of these Terms.

9. Service Changes and Availability

We may update, change, suspend, or discontinue parts of GetSorted from time to time.

We will try to provide reasonable notice of material changes when practical, but we do not guarantee that every feature will always be available.

We are not responsible for delays, interruptions, data loss, or service unavailability caused by circumstances outside our reasonable control.

10. Intellectual Property

GetSorted™, BrightCasa™, associated logos, designs, text, software, graphics, and other Service materials are owned by or licensed to BrightCasa and are protected by applicable intellectual-property laws.

You may not use BrightCasa or GetSorted trademarks, logos, branding, or content without prior written permission, except for ordinary personal use of the Service.

11. Feedback

If you send us ideas, suggestions, feature requests, or feedback, you agree that we may use them without compensation or obligation to you.

12. Disclaimer of Warranties

GetSorted is provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, BrightCasa disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, and uninterrupted service.

We do not guarantee that GetSorted will always be error-free, secure, complete, available, or compatible with every device.

13. Limitation of Liability

To the fullest extent permitted by law, BrightCasa and its owners, employees, contractors, partners, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of GetSorted.

This includes, without limitation, loss of data, lost belongings, inaccurate inventory records, missed insurance coverage, unsuccessful insurance claims, lost profits, device problems, service interruptions, or reliance on AI-assisted suggestions.

To the fullest extent permitted by law, BrightCasa's total liability for any claim related to GetSorted will not exceed the greater of:

• The amount you paid to BrightCasa for GetSorted during the 12 months before the claim, or
• One hundred U.S. dollars ($100)

Some jurisdictions do not allow certain limitations of liability, so some of these limits may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless BrightCasa and its owners, employees, contractors, and service providers from claims, damages, losses, liabilities, and expenses arising from:

• Your use of GetSorted
• Your Content
• Your violation of these Terms
• Your violation of another person's rights
• Your misuse of AI-assisted features, reports, labels, or inventory records

15. Termination

You may stop using GetSorted at any time.

We may suspend or terminate access to GetSorted if we reasonably believe you have violated these Terms, created security risks, misused the Service, or used the Service unlawfully.

16. Changes to These Terms

We may update these Terms from time to time.

When we do, we will update the Effective Date above. If changes are material, we may provide additional notice through the app, by email, or through another reasonable method.

Your continued use of GetSorted after updated Terms are posted means you accept the updated Terms to the extent permitted by law.

17. Governing Law

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law rules.

Any dispute arising from these Terms or GetSorted will be handled in the state or federal courts located in Alabama, unless applicable law requires otherwise.
